    How to Obtain an O-1 Visa for Highly Skilled Professionals

    O-1 Visa: Individuals with Extraordinary Ability or Achievement

    The O-1 visa is a non-immigrant visa that allows individuals with extraordinary ability or achievement to live and work in the United States temporarily. To qualify for an O-1 visa, applicants must demonstrate sustained national or international acclaim in their field of endeavor. Visas can be issued for up to three years, with the option of extending for another year at a time. O-1 visa holders can bring their spouse and unmarried children under the age of 21 to the United States and may work for more than one employer, as long as each employer has filed a separate petition. O-1 visa holders may travel outside the United States and return with valid documentation.

    The O-1 visa offers a number of benefits, including the ability to bring family members, the option to work for multiple employers, and the possibility of applying for an EB-1 visa in the future.

    O-1 Visa Requirements

    Those applying for an O-1 visa must provide proof of an extraordinary ability in their field of expertise, whether it is in the sciences, arts, education, business, or athletics.     Duration of the O-1 Visa

    The duration of the O-1 visa is dependent on the amount of time the specific job requires. Generally speaking, the maximum amount of time an O-1 visa holder can stay in the US is 3 years. However, extensions of the O-1 visa are allowed in one year increments, up to a maximum of 6 years. If the visa holder has a permanent job offer, the visa can be renewed indefinitely. Furthermore, an O-1 visa holder can apply for permanent residency if they meet the employment-based green card requirements.

    It is important to note, however, that the requirements for the O-1 visa are quite strict and applicants must be able to demonstrate extraordinary ability in their field.

    Overview of O-1 Application Process

    Obtaining an O-1 visa requires submission of Form I-129, Petition for Nonimmigrant Worker to the U.S. Citizenship and Immigration Services. The application includes a petition from the employer, along with evidence of the applicant’s extraordinary ability in their field. The evidence must meet three of eight established criteria for O-1 visas, including receiving awards in the field, published materials, original contributions to the field, or a high salary. Other evidence required for an O-1 visa includes a curriculum vitae/resume, letters of recommendation, and evidence of current or past contracts. The employer must provide information about the job offer and the duration of the stay in the United States. Once the O-1 visa petition is approved, the applicant will receive a Notice of Approval from the USCIS and can apply for an O-1 visa at a US Embassy or Consulate in the applicant’s home country.

    Requesting O-1 Sponsorship (including O-1 Extensions)

    The O-1 visa is available for individuals of extraordinary ability in their field. It can be used for those who are coming to the United States to perform in their field. If you are thinking of applying for an O-1 visa, the process can seem intimidating. However, with the right preparation and understanding of the process, you can make the process easier.

    The first step in applying for an O-1 visa is to gather all relevant documentation, such as evidence of extraordinary ability in your field. These materials will be necessary to submit with Form I-129, Petition for Nonimmigrant Worker, with U.S. Citizenship and Immigration Services (USCIS).     The employer must also be able to show that they are able to pay the beneficiary the prevailing wage for similar positions in the area. Additionally, the employer must provide a detailed itinerary of the proposed activities in the United States.

    Extensions of the O-1 visa are possible and may be requested by the employer. The employer must be ready to provide additional evidence for the extension as well as provide an updated itinerary.
